APPS TO SPEND PEOPLE: THE STRIKE OF DELIVERS FROM APPS BEFORE THE LABOR LEGISLATION WITH NEOLIBERAL STAINS

Abstract

This article analyzed the issues that involved the series of strikes called “Breque dos Apps”, the actions taken by the delivery employees and the iFood company, verifying the compatibility of these actions with the legality through a labor law bias and present the perspectives of future strikes, since the stoppages continue. In this approach, the deductive method was used, starting from general legislative propositions to establish particular conclusions in relation to the actions taken during the strike, categorizing the research as exploratory with bibliographical and documentary procedures. The research was divided into three stages; firstly, the economic and social context that led to the stoppage and the actions taken by the parties. Secondly, the legal relationship that unites them is addressed, since the legal consequences of actions are dependent on their legal relationship status. In the third topic, the approach then situates these consequences based on the relationship assessed in the previous topic. The justification for the study of this subject is based on the possible improvement of the understanding of what happened and what is happening during these strikes, as well as to indicate ways for the problems that surround it. In conclusion, it was found that the movement is not subsumed in the legal concept of strike and that the Labor Reform did not adapt the labor legal perspective to modern labor relations, being short-sighted to the technological and factual advancement of these relations.
